The Berlin Loft values the privacy of its customers. Therefore, we would like to explain to you how we collect, use, and share data. This privacy policy informs you about our data protection policies regarding data we receive from our customers. This includes data we collect through our website, where you can access this privacy policy, as well as third-party websites through which The Berlin Loft's services can be requested (e.g., EventInc.com, and others). Additionally, this includes data we collect through software applications that we provide for use on or through computers and mobile devices (collectively referred to as the "Applications"), or through social media pages controlled by us where you can access this privacy policy, via HTML-format email messages that we send you containing a link to this privacy policy, or through your communication with us when you visit our location. By providing personal data and other information, you agree to the terms of this privacy policy.

 

Collection of Personal Data

"Personal data" refers to information that allows the identification of a person. The personal data we collect includes: name, gender, private and business addresses, telephone number, and email address, salutation, and information regarding your service preferences. If you provide us or our service providers with personal data about other individuals in connection with the services (for example, when you make a reservation for another person), you confirm that you have the consent of those individuals regarding the sharing of their data and allow us to use that data according to the provisions of this statement. Collection of Personal Data When Using the Contact Form

When using the contact form, we collect your personal data (name, email address, message text) only to the extent you provide it. The data processing is for the purpose of contacting you. The processing of the data entered in the contact form is therefore based solely on your consent (Art. 6 para. 1 lit. a GDPR). You can withdraw this consent at any time. A simple informal notification via email to us is sufficient for this. The legality of the data processing operations that took place prior to the withdrawal remains unaffected by the withdrawal. The data you enter in the contact form will remain with us until you request its deletion, withdraw your consent to its storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been fully processed). Mandatory legal provisions, especially retention periods, remain unaffected.

Use of Email Address for Sending Newsletters

We use your email address, independent of contract processing, solely for our own advertising purposes for sending newsletters, provided you have expressly consented to this. The processing is based on Art. 6 (1) lit. a GDPR with your consent. You can withdraw your consent at any time, without affecting the legality of the processing carried out based on your consent until the withdrawal. You can unsubscribe from the newsletter at any time using the appropriate link in the newsletter or by notifying us. Your email address will then be removed from the distribution list.

"Other information" refers to information that does not allow for the identification of your identity or does not directly relate to a person, such as:

Your Browser or Device: Certain information is automatically collected by most browsers or through your device, such as MAC address (Media Access Control), computer type (Windows or Macintosh), screen resolution, operating system and version, manufacturer and model, language, internet browser, and version, or the name and version of the online services you are using. We use this information to ensure the proper functioning of the online services.

IP Address: Your IP address is a number automatically assigned to your computer by your internet service provider. When a user accesses the online services, the IP address is automatically logged in our server's log files along with the time of the visit and the pages visited. Collecting IP addresses is standard practice and occurs automatically on many websites, applications, and other services. We use IP addresses for certain purposes, such as measuring website usage, diagnosing server problems, and managing the online services. We can also infer your approximate location from your IP address.

Use and Disclosure of Information

Unless otherwise required by applicable law, we may use and disclose other information for any purpose. This also applies to external providers of websites or services linked to the services, payment service providers, or external third-party websites that serve as landing pages for the high-speed internet providers of our location. The provision of a link in the online services should not be construed as an endorsement of the linked website or service by us or our subsidiaries. We have no control over and are not responsible for the collection, use, and disclosure of your personal data by such third parties.

Moreover, we are not responsible for the policies and practices of other companies regarding the collection, use, disclosure, and privacy of data, such as Facebook, Apple, Google, Microsoft, RIM, or other app developers, app providers, operators of social media platforms, operating system providers, mobile carriers, or device manufacturers. This includes personal data that you share with other companies via or in connection with our social media pages.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to us as the site operator. You can recognize an encrypted connection by the fact that the address bar of the browser changes from "http://" to "https://," and by the lock symbol in your browser bar.

When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties. 

Use of Server Log Files

The provider of the website automatically collects and stores information in so-called server log files that your browser transmits to us. This includes:

- Operating system used

- Referrer URL

- Hostname of the accessing computer

- Time of server request

- IP address

There is no merging of this data with other data sources. The legal basis for data processing is Art. 6 para. 1 lit. f GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

Use of Cookies

The website uses so-called cookies in part. Cookies do not harm your computer and do not contain viruses. Cookies are used to make our offering user-friendly, effective, and secure. Cookies are small text files that are stored on your computer and saved by your browser. Most of the cookies we use are so-called "session cookies." They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies allow us to recognize your browser the next time you visit. You can set your browser to inform you about the placement of cookies and allow cookies only in individual cases, deny the acceptance of cookies for specific cases or in general, and activate the automatic deletion of cookies when closing the browser. However, we would like to point out that you may not be able to use all features of this website to their full extent. Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies," text files that are stored on your computer and allow an analysis of your use of the websites/apps. The information generated by the cookie about your use of these websites/apps is generally transmitted to a server of Google in the USA and stored there. If IP anonymization is activated on these websites/apps, your IP address will be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area beforehand. Only in exceptional cases is the full IP address transmitted to a server of Google in the USA and truncated there. Google will use this information on behalf of the operator of these websites/apps to evaluate your usage of the websites/apps, compile reports on website/app activities, and provide other services related to website/app usage and internet usage to the website/app operator.

(1) The IP address transmitted by your browser within the framework of Google Analytics will not be merged with other data from Google.

For the app, you can prevent this by disabling the "Collect Statistics" function in the settings.

(4) This website/app uses Google Analytics with the "anonymizeIp()" extension. This means that IP addresses are processed in a truncated form, thereby preventing direct identification of individuals.

Use of the Facebook Plugin

Our pages incorporate plugins from the social network Facebook, provider Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA. You can recognize the Facebook plugins by the Facebook logo or the "Like" button ("Gefällt mir") on our page. When you visit our pages, a direct connection is established between your browser and the Facebook server through the plugin. This gives Facebook the information that you have visited our page with your IP address. If you click the Facebook "Like" button while logged into your Facebook account, you can link the content of our pages to your Facebook profile. This allows Facebook to associate the visit of our pages with your user account. We would like to point out that as the provider of the pages, we have no knowledge of the content of the transmitted data and their use by Facebook. Use of the Google Maps Plugin

We use the function to embed Google Maps from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google") on our website. This function allows the visual representation of geographic information and interactive maps. When Google Maps is integrated into the pages, Google collects, processes, and uses data from visitors to the pages. There, you will also find the option in the privacy center to change your settings, so you can manage and protect your data processed by Google. Your data may also be transmitted to the USA. There is an adequacy decision from the European Commission for data transfers to the USA. You have the right to object at any time to the processing of your personal data which is based on Art. 6 (1) f GDPR for reasons relating to your particular situation. To do this, you need to disable JavaScript in your browser. However, we would like to point out that in this case you may not be able to use all features of this website, such as the interactive map display, to their full extent.

Use of the Vimeo Plugin

Our website uses plugins from the video portal Vimeo. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

When you visit one of our pages that has a Vimeo plugin, a connection is established to the servers of Vimeo. This informs the Vimeo server of which of our pages you have visited. Additionally, Vimeo obtains your IP address. This applies regardless of whether you are logged into Vimeo or do not have an account with Vimeo. The information collected by Vimeo is transmitted to the Vimeo server in the USA. Unfortunately, the security of any data transmission over the internet and any data storage system cannot be guaranteed 100%. Choices, Access, and Storage

Access to, Modification, and Deletion of Personal Data
